Most probably your cpu or ram...what is your spec? I've a GeForce MX400 card - and hopefully the game arrives tomorrow - judging by what everyone has said this card is ok (apart from the lighting)

Moved to 06 Technical Issues.

Here's the specs:
    - Windows 2000 or Windows XP (Windows 95,NT,98, 98 SE and ME are not supported).
    - 1.0 GHz Intel Pentium III or faster processor.
    - 256 MB or more RAM.
    - 1580 MB free hard disk space plus space for the Windows swap file and save data.
    - 32 MB DirectX 9.0c Compatible Video card
    - 16x CD-ROM/DVD-ROM drive using 32-bit CD-ROM driver
    - Sound card with DirectSound support and DirectX 9.0c compatible driver
    - DirectX 9.0c

    Supported 3D Graphic Accelerators:

    - ATI Radeon 7500 or greater
    - ATI All-In-Wonder 9700
    - NVIDIA GeForce 2/MX/GTS/Ultra
    - NVIDIA GeForce 3/Ti

    - NVIDIA nForce Onboard
    - NVIDIA nForce2 Onboard

It also said that some testes with the Geforce4 MX cards needed to have their drivers upgraded, so you might want to give that a try.

You'll find the detail settings under the 'Options' menu...

Ok let me rephrase that..it works fine once I get to the main menu..then it is still all choppy..im so confused on what to do..before it was choppy right from the start now..its just choppy once I go to the main menu..

That's weird for it to be choppy in a menu...I doubt that takes up much system resources. But make sure you close all other applications that are running in the background. To do this click CTRL+ALT+DEL at the same time and click the task list and close any tasks lists that don't say SYSTEM by them. That should help...

Your graphics card would not cause an error like that...it would cause low fps in game but not a messed up menu like that. Maybe you have a bad copy of the disc.
