If the RAM really that faulty, he'll probably have some issues before he even tries to launch a game. And again, he would have much more issues with a texture-intensive game like Crysis, yet it doesn't seem to occur with it, just with 2K9.
But I guess you can certainly download and run memtest just to make sure Cindicate.
