edit: Wait! I think you have to buy the dvd copy and activate from steam damn...

No, this is common with Steam games, it will be available to buy sometime today. Unless it is preset to unlock and so on at a specific time, someone has to come into the office and do it manually.
2K clearly did not do the former. So you have to wait until they come into work and do it.

Play some last 2K9 while you wait. I've been playing it these last few days so I can really tell what's changed.
And to clarify for others, basically when you add a game to Steam you can do three things:
1. Have it automatically show up for purchase/unlock/etc. at a specific time.
2. Same, but whenever the servers roll over to a specific day.
3. Or wait for someone to come in and "unlock" it at which time it becomes available.
Now, most developers will put up a preorder, so you can buy the game a week or so ahead, and download all but a few key files, then on release, those last few files come in, and you can play. 2K has not done this, so the game will only be available whenever they (or possibly someone at Valve) come in and send in the activation key, at which point, Steam will display it for purchase, and send out the news item of its availability.
In other words, don't sit around refreshing and getting pissed. Both 2K and Valve are on PST. Be patient.

hey guys if i download it from steam will i be able to burn it to a data disk so just in case i need files again i can go back to it wit out dlding all over

Right click the game -> Backup Game Files.
