Grizzlies staff without pay as club nears bankruptcy

Memphis' future in the NBA remains in the balance after staff were informed today they have not been paid this month. Grizzlies administrators called staff in for a meeting and asked them to carry on working for another week as a 'goodwill gesture' as they continue to look for a buyer. Joint-administrators are continuing in their efforts to sell the team, with latest reports suggesting there are four interested parties. Grizzlies were also hoping to complete the trade of several players, with money going towards keeping the club running, but as yet no deal has been struck.

The company that holds the rights for the name of the arena, FedEx, will be placed in administration by its former chairman, next week. Memphis staff warned at the time that unless a buyer was found quickly, the club were likely to go bust. Memphis finished 24-58 last season, and earned the 2nd pick in the 2009 draft, used to draft Hasheem Thabeet. Owner Michael Heisley will hold a further meeting with staff next Friday, by which time he is hopeful of having some positive news regarding the sale of the club.

He said: ''We are still negotiating with four seriously interested parties, but the process of disposing of the shares in a basketball team is an extremely complex one, even more, talking about an NBA team, and it has not yet been possible to conclude a sale. However, I am confident that we are very close to entering into an exclusivity arrangement with one of the interested parties.''

Memphis deny they are to go bankrupt

The Memphis Grizzlies have attempted to ease the fears of their supporters following media reports the club are in serious financial trouble, and in sale. The team, founded in 1995 in Vancouver, have been in the news this week with regards to their economic plight, but owner Michael Heisley insists talk of bankruptcy is well wide of the mark. "I want to state the following: in first place, what is utterly false is that the club is in bankruptcy," Heisley said to NBA TV. "Secondly, we are working hard to implement a viability plan that will give economic and financial stability to the club and that, obviously, has its difficulties."

He added: "We are working on the economic viability of the club. It's having it's difficulties, as do all businesses. We are working on it and we hope to achieve it. To the fans we want to ask them to be calm, because we are working hard to obtain this economic and financial stability and achieve what we all want, which is sporting success. We are working with the financial institutions, as is usual." Media reports said yesterday that "(Memphis) are still negotiating with four seriously interested parties."

Pippen offers to buy bankrupt Grizzlies, move team to another city

Scottie Pippen is in the hunt for a NBA franchise. Pippen tabled an offer on Tuesday to purchase the Memphis Grizzlies, following the team's bankruptcy filing. The hitch in the offer is that it is conditional on relocating the team. The offer to purchase the club is pegged at $212.5 million. "This is the deal that I am focused on," Pippen said today at a brief news conference in Chicago. "This is the opportunity that's come up out of the bankruptcy financing. I am prepared the financially back it. I think this is very good for the game, very good for the league, very good for the fans." Pippen has also agreed to help the team by supplying $17 million US to keep the team afloat prior to the proposed sale.

The NBA was quick to react to the news - commissioner David Stern issued a statement on Tuesday night outlining the removal of Grizzlies' owner Michael Heisley from authority to act as a representative for the Grizzlies in league business. "We have just become aware of today's bankruptcy court filing purportedly made on behalf of the Memphis Grizzlies. We are investigating the circumstances surrounding the petition, including the propriety of its filing. We have removed Michael Heisley from all positions of authority to act for or on behalf of the club. The league will appear and proceed before the bankruptcy court in the best interests of all of the club's constituencies, including its fans in Memphis and the league's 29 other member clubs."

Heisley earlier told the media: "Extensive efforts have been undertaken to sell the team, or attract additional investors, who would keep the team in Memphis." Heisley bought the team in 2000 with a promise to keep the Grizzlies in Vancouver. However, attendance at Grizzlies' home games dropped slightly in the 2000–01 season. Fan support increased after it was widely believed that the team would be moved before the next season. "This is a very serious and committed offer by me and it's funded and financed and fully backed," said Pippen.

Pippen has set up a website, www.memphisgrizzliesout.com, and is encouraging people to sign up to support the relocation of the Grizzlies. Pippen later said that more than 2,000 fans signed up for the site within 100 minutes of it going live.

NBA seeks control of bankrupt Memphis team

The NBA is seeking to overturn a bankruptcy filing by the owner of the Memphis Grizzlies that is intended to facilitate a sale of the team and a move north of the border. The Grizzlies, owned by Michael Heisley, filed for bankruptcy on Tuesday, saying Scottie Pippen, former player of the Chicago Bulls, Houston Rockets and Portland Trail Blazers, had offered $212.5 million for the club. Pippen plans to move the team. Heisley' attorneys have said a decision is needed by the end of June if Pippen is to move the team before the 2009-2010 NBA season begins.

The NBA has moved to block the bankruptcy as well as a sale to Pippen. "It's our position we're in control of the club," NBA commisioner David Stern said. He pointed to NBA rules as well as documents Heisley signed before the bankruptcy filing turning control of the team over to the league. NBA officials have called the filing a move to skirt league rules governing franchise sales and relocation, which must be approved by a majority of the 30 NBA teams.

While several bankruptcy attorneys and sports law officials said the bankruptcy judge likely cannot rule on whether Pippen can move the Memphis team, attorneys said they believe the court can find the NBA has engaged in anti-competitive behavior and allow the transfer to occur.

BANKRUPTCY JUDGE REJECTS SALE
Memphis team won't be sold to Pippen

The NBA vowed to find an owner that will keep the Memphis Grizzlies where they are, after an Arizona bankruptcy judge rejected Scottie Pippen's bold bid to buy the insolvent team and re-locate it. The judge made his highly anticipated decision public earlier in the evening, saying in a 21-page ruling that there wasn't enough time to deal with all the unresolved issues raised by the unprecedented case. That prompted Pippen to propose to the NBA to work with it, in an attempt to find "an appropriate" relocation fee to move the team. But buoyed by the judgment, the league says it plans to help a future owner make the Grizzlies viable, and its claims that four parties have expressed an interest in operating the team there will now be put to the test.

"We are confident that we will be able to find such a buyer for the Grizzlies," commissioner David Stern said in a statement, "and that the claims of legitimate creditors will be addressed." The ruling brings to a close more than a month of intense of often dramatic legal manoeuvring, set off when Pippen sought to buy the Grizzlies with a US$212.5 million offer that was conditional on being able to move the team. But the judge rejected that and several aspects of the arguments made by his lawyers, writing their claims that the league's refusal to allow the team to move does not violate antitrust law and permit "the sale free and clear of the relocation rights of the NBA."

Typically, the NBA and Pippen didn't see eye-to-eye on the ruling. The NBA, which had argued that his bid was designed to skirt rules on the transfer of ownership and relocation and should be rejected for that reason, said it was "pleased" the decision "recognized the validity of league rules and our ability to apply them in a reasonable fashion."

That led Pippen to ask the NBA to work through the relocation application he recently filed. "Scottie Pippen's bid to re-locate the Grizzlies continues," a spokesman said in a statement. "We still think there is enough time for the NBA to approve Mr. Pippen's application and move the team by September." Given the bitterness with which this saga played out, there's little chance of that.

Memphis Grizzlies, bankrupt NBA team, to be auctioned

The Memphis Grizzlies, the bankrupt NBA team owned by Michael Heisley, will be put up for sale at the first of two potential auctions, a judge ruled. The first auction would be open only to bidders willing to keep the team at its current location, a proposal supported by the league. If that auction doesn’t attract an acceptable offer, then other bidders, including Scottie Pippen, would be allowed at a September auction to try to buy the team and move it.

A judge had been asked by the Grizzlies and the NBA to decide which of two competing auctions to approve. Team managers wanted to consider all offers at once, while the NBA proposed the two-phase auction. Lawyers for the NBA said they expect an offer from Clyde Drexler, former Trail Blazer and Rocket. A term sheet with details of Drexler’s offer, which would keep the team in Memphis, should be available by the end of the week.

The NBA and Heisley disagree on what should happen if the first auction doesn’t generate an acceptable offer. The league is willing to consider allowing the Grizzlies to move at that point if a new buyer agrees to wait until the start of the 2010 season, Clark said. Attorneys for Heisley and Pippen both said a sale to move the team must close by mid-September.

Drexler offers up to $148 million for bankrupt NBA team

Clyde Drexler, "The Glide", bid up to $148 million on Friday to buy the Memphis Grizzlies in a move to keep the bankrupt National Basketball Association in Tennessee.

Drexler, former player of the Portland Trail Blazers and Houston Rockets, submitted a bid in the U.S. Bankruptcy Court in Arizona that was below the $212.5 million previously offered by Scottie Pippen. Pippen plans to move the team. Friday was the deadline for submitting bids for an Aug. 5 auction limited to bidders planning to keep the team in Memphis. If Drexler's bid is deemed inadequate, the court will hold a second auction -- open to other bidders who have the option to move the team. Drexler's bid was the only one submitted at around 9 pm ET.

NBA officials could not be reached for comment and the attorney for Grizzlies owner Michael Heisley said he was still reviewing the offer and had no immediate comment. In his bid, Drexler said he expects to renegotiate the team's arena lease agreement with the city, as well as reach new deals with FedEx and the team's regional TV broadcaster. Pippen offered to buy the team when it filed for bankruptcy protection in May, on condition he be able to relocate the franchise.

The NBA has maintained that it wants the team to remain in Memphis, but a spokesman for Pippen said his client's position has not changed and the league might have to change its position.

New group plans offer for bankrupt NBA Grizzlies

A third group that could potentially bid for the Memphis Grizzlies is a group of Eastern Europeans who plan to re-locate the bankrupt National Basketball Association team, representatives for the group said on Saturday. "We're looking at it as a potential investment," one of the businessmen said today. "The scenario itself is enticing. You have a company in bankruptcy and one bidder." Grizzlies owner Michael Heisley put the team into bankruptcy in May with the plan to sell it for $212.5 million to former NBA player Scottie Pippen, who wants to move the team. The NBA opposes relocation of the team and has backed a bid of up to $148 million by Clyde Drexler, a former NBA player as well.

Drexler was the only bidder to submit an offer by the court's deadline for parties wanting to keep the team in Tennessee, but definitive bids are not due until July 24. If bids by Drexler or others are deemed inadequate, a second auction would be held and open to bidders who have the option to move the team, where the Eastern Europeans would take part.

The Grizzlies are considered one of the less valuable NBA teams. The businessman from the Eastern European group said his group has experience in finance, entertainment and marketing, but would not reveal who they are. The plan would be to re-locate the team, to another city, not yet revealed. "We have every intention to move forward if the cards fall as we expect them to," the businessman said.
