Will Live 365 provide us an update that includes rookies like Blake Griffin or Ricky Rubio after the 09 draft or will EA wait till next year to include those players?

No, the NBA Live 365 service for NBA Live 09 only covers the 08/09 season.

That's shit.

I was thinking of buying a console to enjoy live 365 updates, but fuck that, there is no point till Live 2010 comes out.

From the moment NBA Live 365 was announced, EA was clear that the service ended with the 2008/2009 season. If NBA Live wasn't an annual release it might have been different but since a new one does come out every year they're not going to continue updating a superceded product.

Forgive me, this may be posted somewhere but I'm asking anyways.
Is the live 365 feature going to be on live '10?
If so, will our subscriptions continue or are we out additional dollars each season?

Yes, NBA Live 365 and Dynamic DNA will be a part of NBA Live '10. Subscriptions for NBA Live 09 will not carry over, but all new copies of NBA Live '10 will include a subscription free of charge courtesy of a sponsor (possibly T-Mobile again). As with 09, if you buy the game second hand you'd need to purchase a subscription seperately if you want it.
