Are you suggesting that because a girl that is promiscuous, she cannot be raped? If that's Kobe's defense, he's as good as guilty.

I was talking to EG about this, and the scenario he suggested is the most likely in my opinion. We know that Kobe did have sex with the accuser (if he didn't, admitting to it was a pretty stupid thing to do ), he claims it was consensual while she claims it was rape.

As she's got a history of mental illness and depression, she has likely decided at some point that she was raped - to her, it has become a reality, an event that she truly believed has happened. I'll never claim to be an expert on mental illness or psychology, but I know this happens with some people.

So assuming EG's suggestion is what has actually happened, portraying her as a gold digger or a bad person is still a little unfair. If she's truly mentally ill and her allegations are based on events that she's decided really happened (as opposed to simply making up a story to get him into trouble and then make some cash in a civil case), the case should be dismissed and she needs to get some professional help.

And if that's the way things are, Kobe has been very unfortunate to have been involved with a person suffering from such a mental illness. Some might suggest he could have easily avoid such a situation, but if his wife can forgive him for making such a mistake, I'm sure most people won't hold a grudge.

Im a big Kobe Bryant fan, and I must agree that calling her a golddigger, bitch, liar and whatever is unfair because nothing has proven yet. Maybe Kobes´s statement of not being guilty is a lie aswell.......Maybe Kobe did it afterall we dont know but as Andrew said, someone with mental problems can still be raped by someone.

As much as I hope as a fan that he is not guilty, there is still a chance he is, but at this moment in my eyes he is innocent because he still hasnt been proven guilty, I will have to wait with my opinion on her being a liar or not when the sentence has been made official by the judge.

But would the verdict be "correct"? Take OJ Simpson for example. He was found not guilty, but most people don't seem to believe the verdict. If Kobe is found guilty, did he really commit rape? If he's found not guilty, has he just gotten away with committing a crime? Is the accuser's story true, and if not, is she making it up out of spite or is she genuinely mentally disturbed?

As so many people have said since the news first broke, we'll never know the complete truth.

Well basically... I know that it isn't fair to say that the prosecutor is innocent because of my prejudice.... she has had a history of mental illness (?) , depression and there are witnesses coming out saying that they did have sex in the days leading up to the 'incident' and this makes me feel that if the defence puts up a good case...Kobe could win.

But what really happened in that hotel room...only Kobe Bryant; the accused and the prosecutor know.

I think that out of both of them- one of of them might be lying and it's pretty big to lie under oath. Especially if it's Kobe Bryant. And if Kobe is saying he's innocent now- and he changes his plea to guilty later on- that's petty suspect.

But I'm no legal expert and I can't generalise on many things because I don't know what witnesses or evidence or what the prosecution/accused arguments are. Also- I think US law is different to the Australian legal system.

I don't understand why they let him off....some people I know reakon that the Jury were getting sick of the trial because it was going for 200 + days...I don't know. I was too young at the time to remember.

Kobe's case has some parrallels to OJ SImpson's trial. Both will be televised on TV... both will make a lot of money. And many people will want to know what happens. If enough evidence is put up by the defence then because of the people watching...who by then will see the evidence put forward and believe Kobe is innocent...the jury will have to acquit him. But if Kobe's defence cant defend him at all...the jury will have to send him to jail.

Also...if the case is too mind-boggling for the Jury...we'll have a hung jury...and more t.v. ratings!

So who is telling the truth? Only time will tell!

That's kind of what I was alluding to. If Kobe is found not guilty simply because there's not quite enough evidence or there's a problem with some of the evidence...is he really innocent? If so, then should we accept and believe that OJ Simpson is innocent as well? A jury decided that he was innocent, yet most people seem to believe he got away with murder.

Don't get me wrong. It would be very unfortunate if the allegations turned out to be true and Kobe was sentenced to prison for up to 20 years. I certainly don't want to see him there if he's innocent, nor am I hoping they'll find him guilty. But if he is, he should be punished the same as Joe Nobody.

That certainly remains a possibility, but I still think that if the accuser is lying, her mental problems might be the cause rather than greed. If she's so disturbed that she's somehow decided she was raped when it was actually consensual sex, has she done something wrong? Yes and no. It's a terrible accusation, one that has tarnished Kobe's reputation by making the affair public and dragging his name through the courts, but if she's not of stable mind, can you really say that she did it deliberately or maliciously? To put it another way, is she really a gold digger, or someone that desperately needs professional help?

If the scenario I mentioned before is what has actually happened, I suppose its up to the court to decide whether it should be treated as a false accusation. I would say that it shouldn't. After all, if people may have a reduced sentence for murder on the grounds of mental illness, then surely she shouldn't face a harsh penalty for a claim she (unfortunately) truly believes is genuine.

Of course, the prosecution will reject that claim, which should be easier now that the accuser's medical records cannot be used by the defense. The prosecution will say (quite rightly) that just because a person is mentally ill or promiscuous, that doesn't mean they cannot be raped.

But the trial will probably come down to "he-said, she-said", in which case it will probably be dismissed, which is basically the same as finding Kobe not guilty. I don't know if that would be a good thing, though. If the case is dismissed due to a lack of evidence, there will still be question marks, as there are with the OJ Simpson trial.

That brings me to my next point: would it be wise for Kobe to seek action against the accuser if the trial is in his favour (either not guilty or a dismissal)? I won't claim to be a legal expert either, but I would think it's in his best interests to put the whole ordeal behind him. The fact that he put himself in this situation by committing adultery has hurt his image. If she's going to be prosecuted for making a false accusation then so be it, but I think a civil case might actually make Kobe look like the bad guy.

It must sound like I believe Kobe is guilty, but again I, like everyone else, have no way of knowing whether he's guilty or innocent. I'm inclined to believe that he's innocent, but a lot of people forget that the accuser is innocent until proven guilty too (that is, guilty of making a false accusation). Even though I'm inclined to believe the scenario mentioned above, there's a possibility that Kobe committed a crime and she's telling the truth. At the very least, I don't think she's the gold digger she's often portrayed to be since the incident was first made public.

You know, even though I feel that some Kobe fans are a little hard on the accuser at times, I must admire your faith in Kobe and the way you support him unconditionally. I would like to think that I would show the same support if Michael Jordan had ever faced such charges.

well.. I think they will be using the police interviews as evidence against Kobe but the defence will try and make the interviews not to be able to be used as evidence....

I have faith in Kobe Bryant...that he didn't rape the girl...they only had sex. But I don't know for sure.

The Spurs series was for Kobe. This one is for Shaq. No one will come remotely close to stopping him.

Kobe will have his usual numbers, though I think he'll subside to Shaq more in this series.

If its Lakers Indiana in the finals I expect Kobe to be very motivated against ron artest and i'm sure he wont be stopped...at least i hope so

That's certainly good news for Kobe, but would it really be enough to dismiss the case so soon?

However, the DNA sample taken from her body could refute that line of thinking

Perhaps that will ultimately decide the outcome. I'm guessing that Kobe will have to make at least a couple more appearances before there's a decision. I would think that the court would want to be pretty careful about dismissing the case or ruling in Kobe's favour. If they made a judgement before it was absolutely clear that the charges have no merit, it would reek of an ugly double-standard, just because one of the individuals is a popular athlete.

Well, this is great news for us Laker/Kobe and basketball fans. I still dont think this will end the whole situation and as Andrew said that he will still have to attend court every now and then, but this whole trial goes in Kobes favour right now, and even if they wont dismiss the trial, it will be harder for the jury to judge him guilty or not guilty, which means less evidence against him, which leads into a dismissed trial later

Bryant attorney Hal Haddon said in court filings that Ragle's testimony could raise doubts about the investigation by the Eagle County Sheriff's Office, perhaps enough to clear Bryant, he said.

This thing seems to be going Kobe's way these last couple of days.

Imagine they advance and the same day it's said Kobe's cleared of all charges.
