Seeks $1.5 million from Raptor star
A private-school teacher and part-time model is suing Raptors forward Morris Peterson for $1.5 million for allegedly infecting her with genital herpes.
Daphne Charlemagne, 26, is seeking $1 million in general damages and $500,000 in special damages.
Her case was originally filed in June 2002 — a year and a half after she says she met Peterson and began having an "intimate relationship" with him — but hasn't advanced to a trial because Peterson has not filed a statement of defence, said Joseph Lo Greco, Charlemagne's lawyer.
A judge is to set a trial date on Wednesday.
Lo Greco said the case probably wouldn't begin before December.
The allegations against Peterson have not been proven. A Raptors spokesman said Peterson wasn't available to comment.
Charlemagne alleges that Peterson either knew or should have known that he had and was a carrier of genital herpes.
"The medical condition she now suffers as a result of the negligence of the defendant will prevent her from engaging in any meaningful relationship with other men and the prospects of marriage are remote," Charlemagne's statement of claim says.
In her affidavit, Charlemagne said she met Peterson on Dec. 19, 2000, when she attended a Raptors game and sat behind the team's bench.
Peterson and Charlemagne allegedly began dating days later. Within two months, on Feb. 22, 2001, Charlemagne said she was diagnosed with herpes. She did not have any other male partners during the time she dated Peterson, Charlemagne's affidavit said.
"After knowing that I had genital herpes, I advised Morris Peterson that I contracted the virus from him," she said in court documents.
"He never called me or showed any remorse."
Charlemagne has asked the court to force Peterson to pay her $4,000 a year in damages until she reaches the age of 40 to replace modelling income she's allegedly lost after contracting the disease.
Besides demanding special punitive damages, she has also asked for $2,000 (U.S.) a year for the rest of her life to pay for herbal medication supplements to treat her condition.
The Raptors in July matched a three-year, $15 million (U.S.) offer sheet tendered to Peterson by the New Orleans Hornets. He has spent his first four NBA seasons with the Raptors after Toronto selected him in the first round of the 2000 NBA draft.
