Chapter 8
Judge Phoenix was getting impatient, repeatedly checking his watch for the time. The courtroom was full; all the seats were taken. The men and women were talking to each other so quietly it was as if they would be asked to leave if they spoke up. Phoenix was less than impressed as he counted the minutes going to waste. He could have started the court proceedings by now. It was a cold morning and the warm air was beginning to get a little too warm for some members of the jury. One man, who was sitting beneath the heating system, perched on the wall, stripped off his jacket and jumper. A few people took it as a cue and did the same. Phoenix slowly sipped his glass of water and then nodded at the bailiff. The bailiff approached the front of the court.
The doors swung open creating a loud thud as the door on the left hand side opened the full rotation and hit the wall. Heads turned to see who it was and Phoenix glared at the extremely late arrivals. A short man wearing glasses and donning very greasy pushed a small shopping cart into the room. Everyone saw papers stacked inside of it and a small box seemed to act as a paper weight. Following him was the son of the late Barry Johnston. Larry was accompanied by two of his friends and they quickly found some places to sit amongst the sea of faces who had decided to come in to take in the case. There was a collective gasp as David Weaver strutted in. He was wearing a pirate costume with an eye patch and fake parrot on his shoulder. Phoenix just shook his head in annoyance.
“Sorry I’m late your honour,” Weaver proudly exclaimed, “I’m just showing you how ridiculous I believe this case is!”
Phoenix didn’t care, “Ok now, let’s start this. Court is in session.”
“I would like to call upon my first witness,” Weaver stated, “Mr Robert Wilson.”
Wilson hopped into the witness’ stand and took the oath. Weaver began with his questions.
“Mr Wilson, you have known Mr Sit for how long?”
“Since he started to work for the Atlanta Hawks.”
“And that’s been?”
“About three months I’d say.”
Weaver nodded, “And has he shown a tendancy to become violent when provoked?”
Albino stood up, interjecting before Wilson spoke, “Objection! Irrelevant to the case.”
Weaver wagged his finger at Albino, “I am merely getting evidence to prove that the defendant is prone to sudden, psychiatric and violent outbursts.”
“And how is that exactly relevant to this case?” Albino challenged.
Weaver rebutted, “I will establish the ill character and the criminal intent of Sit before I present my solid evidence.”
“That’s bullshit,” Albino said, thumping his fist on the desk, “You present the case properly. Judge Phoenix, I don’t know what you’re smoking but why are we even here? This isn’t an audition for a Hollywood script you know?!”
Weaver shouted, “We’re here to send your client to jail. He killed a man!”
Sit jumped over the table and bolted towards the Greek lawyer, shoving him into the wall. Sit grabbed him by his collar as blood and hatred started to pump through the Asian’s veins.
“You don’t say that about me!” He spat in Weaver’s face, “Where’s your evidence aye?”
Two officers raced to the front to pull Sit off of Weaver and escorted him out of the room. The Greek lawyer just laughed.
“Order!” Judge Phoenix’s voice boomed out, everyone stopping to face the front of the court again.
Weaver and Albino watched Sit being dragged out of the courtroom before Phoenix ordered, “May the two representatives of the prosecution and defence please approach the stand.”
The two barristers moved up to stand in front of the judge.
“I will not tolerate any more of this circus act that the two of you are creating. I want an orderly case from now,” He briefed them, “David – go and get a change of clothing. I will remind you two that I will throw either of you off this case if you keep screwing around.”
Albino begged, “Your honour – is this some kind of sick joke? My client, there’s no case to present from either side. It’s ambiguous as to what really happened? How did this even get past the prelim hearings? There’s absolutely no substantial evidence to prove that my client is guilty.”
“That was not my decision,” Phoenix answered, “Just work with that you have.”
The Judge then stood up and announced, “Court is adjourned for one hour’s break.”
With that he left and Weaver glared at Albino, “You better watch out kid. I got something that will beat your buddy’s ass back to Australia.”
Weaver turned to leave and Albino called after him, taunting, “You’re not Johnny Depp you know?”
The ball sailed through the air and dropped right through the middle of the hoop. The crowd was screaming at the top of their lungs before the rock was stolen at mid court and sent back down on the fast break.
“Pass it here!” someone screamed.
There were two guys open on either side but Kobe Bryant ignored them. He continued to go himself and wound up pushing his weight off the floor just in front of the hoop. He twisted to his right and then brought the ball around his body in one swift motion before slamming it down into the iron rim. The crowd jumped up in excitement as the Wizards called a timeout.
“Caron,” Eddie Jordan yelled out above the deafening roar of the STAPLES Centre crowd, “I want you to take it to the Lakers. This is you old team kid! You right to go?”
Butler who had rolled his ankle in the first quarter nodded and got ready to get back onto the court for some more game time. The players got up and put their hands in the huddle before shouting out their team name. As the Wizards got back onto the court, Phil Jackson could be heard from a distance.
“Kobe, I want you to pass more. You’ve got a billion points; it’s time to get everyone else involved!”
Gilbert Arenas who had 29 points brought the ball down as the Lakers set up their defence. Kobe was assigned to chase Arenas around the perimeter. A cutting Butler called for the pass and Arenas ignored him, looking elsewhere for Jared Jeffries. Arenas then whipped the ball away and Jeffries searched frantically for where it had gone. It was the same for the Lakers defenders who were momentarily lost. Before anyone had known, Butler had the ball in his hands but fumbled it before falling out of bounds. The crowd cheered but then it went silent as Butler lay on the floor in one heap. The Wizards gathered around Butler who was rolling around in pain, his eyes began to water.
Magic Johnson spoke into his microphone, “Looks like Caron Butler is hurt Kenny.”
Kenny Smith replied, “This is definitely disappointing for the Wizards, they lose one of their better players now. It was foolish for Eddie to have let him back onto the court.”
“I guess it’s just that the team needed him in this game,” Magic said.
Kenny laughed, “I think the Lakers have won the ball game already!”
The theme song for TNT began to play before Magic added, “This is Lakers Wizards on TNT. Lakers lead 111 to 82, Kobe has scored 40 and we will be back after this break.”
Sit switched off the t.v. and waited for Albino to come into the room. When his lawyer did, he wasn’t looking too happy.
“Don’t do that again,” Albino warned him.
Sit’s smile turned upside down.
“The case will go down the drain if they all think you’re always losing you cool. Ok?”
Sit nodded, “Its cool. I’m sorry yeah?”
“Don’t apologise to me, it’s your future in prison, not mine!” Albino then sat down, “They let you off this time so you’re lucky.”
Sit started beaming and Albino looked puzzled, “You haven’t won the case yet…”
“Kobe scored 40 points so far!” Sit said, smiling and giving him the thumbs up.
Albino laughed, “Watching re-runs of games again?”
“Court is in session,” Judge Phoenix sat down, “From now on, this case will be controlled by me. I expect that this will all go properly and formally. There will be no further distractions in my courtroom.”
Everyone else sat down and Weaver now wearing a pink shirt and pink tie called for Rob Wilson to return to the stand.
“How long have you known the defendant?”
“Objection – Irrelevent!” Albino stated
Phoenix calmly said, “Overruled.”
Wilson then continued, “Three months.”
“In those three months, what has Sit done to you?”
Albino objected once again, “This is irrelevant and hearsay!”
“How do you know it’s hearsay if you haven’t heard the evidence yet?” Weaver shouted back.”
“Order!” yelled Judge Phoenix, “Overruled. Continue please.”
Albino cursed to himself before Wilson told the court about his encounters with Sit. After he had finished, Weaver smiled and thanked him for his testimony. Wilson had done his damage in painting Sit as an egomaniac who had a short temper and was literally a walking time bomb.
Albino had one question, “How do you know Sit’s previous behaviour is what killed Mr Johnson?”
Rob shrugged and Weaver laughed, “Objection. My client isn’t some expert in psychology. How’s he supposed to answer that?”
Phoenix nodded, “Sustained. Defence, please rephrase the question.”
Albino waved him off, “I have no further questions your honour.”
Albino sat down and whispered to Sit, “This is ridiculous. He’s blatantly biased.”
The case ran smoothly as Al Harrington and Mike Woodson testified and Albino kept his mouth shut. He didn’t bother to make any complaints to the Judge nor did he ask any questions during his cross-examinations. He was still reeling from the shock of how biased the Judge could be towards the prosecution. Weaver then nearly gave Albino a heart attack by presenting something more than a simple testimony.
“Your honour and ladies and gentlemen of the Jury,” He calmly stated, “I now present to you proof of William Sit’s intent to kill Mr Barry Johnston. This video tape was intercepted by the police department and is security footage recorded on the night of the accident.”
The bailiff took the small box form Weaver’s assistant as Weaver added, “Mark it down as exhibit A.”
Albino stood up promptly, “Wait, you can’t put in this evidence now!”
Judge Phoenix asked Weaver, “When did you retrieve this new evidence?”
“Just yesterday, the police department only got it yesterday,” Weaver announced.
Phoenix nodded, “We will take a look then.”
The video recording was played and everyone looked stunned as Sit was heard uttering the words of wanting to ‘run down the bastard.’ Sit was shocked and Albino couldn’t believe what he was seeing.
Weaver then continued with the case, “I would like to call upon the defendant, William Sit to testify.”
Sit knew it was coming and he got up to trudge slowly toward the stand. He sat down, raising his hand in the air.
“I swear to tell the truth, the whole truth and nothing but the truth.”
Weaver then paced around in circles before asking, “William Sit, please tell me your past occupation?”
“General Manager of…”
“Before that please.”
“Objection,” Albino said, “It’s irrelevant your honour!”
“I assure you that this will not be irrelevant once he answers the question,” Weaver hissed through his teeth as Albino.
Judge Phoenix looked intimidated, “Overruled.”
Weaver turned back as Sit continued, “I worked at a seven-eleven convenience store.”
Weaver then asked in a curious tone, “So Mr Sit. I’m curious on how a seven-eleven store attendant can become an NBA General Manager?”
“Objection!” Albino yelled out but to no avail.
Sit started to twiddle his thumbs and felt his stomach turn upside down.
“You are under oath,” Weaver sternly reminded him and added, “May I ask as well, how do you get a high position at the age of 21?”
Sit tried to say something but nothing came out. He bent down and put his head in his hands, trying to think of his answer.
Weaver smiled and asked one more time, “Mr Sit, how does a seven-eleven employee become a GM in the NBA? Come on now, you don’t want to keep us waiting do you?”
