Patch Error--Old File Not Found when installing patch..

I'm unable to install the newest patch for Live 07 I downloaded from EA...
when I click on it, it says...

"Old file not found, however a file of the same name was found, no update done since file contents do not match"

and its a clean install I got no cracks or any fishy files or nothing like that its a legit copy of the game, the only thing is.....
I'm running Windows Vista RC1... so could that be the issue?
is there anyway to apply these files without running the patch, like perhaps extract them and manually move them into the proper folders???
