Me too I dont like the fact that he isn't in the game. Furthermore, I don't believe he will be in Nba Live 06 if not they would have make an big announcement the same way they did with Nba Live 2000.
Hm, I'm assuming Barkley, Stockton, and Olajuwon won't be in it either. Man, I'd love to have Olajuwon in the game.

Players in the NBA are under a license agreement between the league and the players' union. And in 1992 Jordan got his own licensing agreement with the league, so has other players (Barkley, Stockton, Olajuwon and so on); so after they retired, they were no longer directly affiliated with the NBA (didn't become a part of the Retired Player Association). So that mean that they can basically name their prize (since they own the licensing to their likenesses), and if companies don't want to pony up the cash for using their likeness, they can't use them. Period.
There's even more to it than Andreas mentioned, simply anouncing retirement doesn't qualify a player to join the retired-players association, a player needs to be retired for a certian amount of time. Notice Drexler was in Live04, but not 03. So Olajuwon, Stockton, and Robinson weren't eligable last year, and Karl Malone won't be this year.
Also, as both the players-association and retired-players-association are unions, team owners such as Jerry West, Micheal Jordan and Dr J are in-eligable and their likness rights are negotiated seperately.
Charles Barkley had avoided the retired-players-association claiming it was a conflict of interest as a broadcaster, but it appears that he might have joined prior to the last all-star break. It's never too early to kiss ass for your HOF campain I guess.
I think if you create a player with a name thats already in their system it should say it. Or rookies too..that would be one of my wishlist but I'm too lazy to go post it.

In Live 2004, 2005 and I guess that in 2006 Marv Albert doesn't say custom player names (even if he is in the system. eg: jordan). Too bad because this year we have a player with the last name Ewing). Actually I don't understand Why was this feature dropped from the game. Not having enough time to add/restore this is stupid since they had almost three years.
Just adding to what Andreas and OldFoolStyle have said, it seems EA are able to include players like Jordan and co for one year after they retire. After that, they're out of the game until a deal can be made.
