NBA 2K11 didn't have fouling out. After six fouls guys are pulled by the PC if auto subs are on, but they can be returned to the game. Why? Because in Jordan mode the opposing teams have no benches, so starters can't foul out or there would be nobody to finish the game. The issue carried over into other modes.
Hopefully this basic NBA rule works in 2K12.

Just a bug. You can use the in-game coaching options to bring players back in.

Hopefully they have been made sufficiently aware of that bug and fix it. Strangely enough NBA Live 10 had issues with played who had fouled out being able to be subbed back in, so the most recent releases from both companies have had oversights with that rule.

It wasn't a bug. The Jordan Challenge teams had only 5 players, no bench. If they fouled out, then what?
It's interesting the bug wasn't fixed with a patch. It's a basic game rule. it would be like a baseball game with players able to come back into the game after being replaced.

Outside of the Jordan Challenge, I'd call it a bug. Within the Jordan Challenge it was obviously by design (the merits and drawbacks of which we've discussed elsewhere), but it carrying over to any other game mode is a bug, oversight, mistake, whatever we want to call it. I agree, it should've been fixed in the official patch but unfortunately it wasn't. Hopefully enough attention has been drawn to it that the issue has been fixed this year, that's about the best answer we can give to the question at this time.

I think what happened was it was added for the Jordan Challenge because opposing players couldn't be allowed to foul out. To address the problem they made it possible to sub "fouled out" players back into the game. It was done in such a way that it wasn't easy to change in other modes. That's the only reason it wouldn't be fixed in other modes, even in the patch.

That's certainly possible. With expanded/full rosters for NBA's Greatest, hopefully that problem will be avoided this year then.
